DISPUTES AND ARBITRATION

Any controversy or dispute arising out of or relating to this Contract which cannot be resolved by mutual agreement shall be decided by the Administrator within 30 calendar days from receipt of a written notice from Contractor, and who shall furnish Contractor a written copy of his decision. Such decision shall be final and conclusive unless within 30 calendar days from the date of receipt thereof, Contractor shall deliver to NIA a written notice addressed to the Administrator that he desires that the dispute be submitted to arbitration. Pending decision from arbitration, Contractor shall proceed diligently with the performance of the Contract and in accordance with the decision of the Administrator.

Pursuant to E.O. No. 1008, otherwise known as the Construction Industry Arbitration Law, all disputes arising in connection with the present contract shall be finally settled under the Rules of the Construction Industry Commission by one or more Arbitrators appointed in accordance with the said Rules. The arbitration proceedings shall be conducted in Metro Manila or such other places as may be agreed upon by NIA and the parties, in English, Filipino, or any other language acceptable to the parties and the arbitrators.

Any dispute, question or difference which may arise at any time between the parties hereto in connection with, or relating to, this Agreement or the subject matter hereof, including questions of interpretation or construction, and which cannot be settled between the parties, shall be referred to the Construction Industry Arbitration Commission and shall be settled in accordance with the Rules of such Commission. The decision of the Arbiter/Arbitration Tribunal formed under the Rules of the Commission shall be valid, binding, final and conclusive upon the parties hereto and from which there shall be no appeal except on questions of law which are appealable to the Supreme Court.

NIA and Contractor shall have the right to institute suit against each other, as the case maybe, in any Court of competent jurisdiction in the Philippines to enforce any decision on award rendered in abitration proceedings. NIA shall have the same right as above to enforce a ruling of the Administrator in the event, said ruling is final and conclusive as above described.
