CORRECTION OF WORKS

Contractor shall promptly remove and replace or correct all Works determined by NIA in writing as failing to meet the requirements of the Contract. Contractor shall at his own expense, remove and replace or correct all such defective Works. Contractor shall not be entitled to extension of time to complete the Contract Work and shall bear the cost of any damage done to other parts of the work resulting from the removal and replacement or correction of such defective Works.

If Contractor fails to start the removal, replacement or correction of such defective Works within 10 calendar days after written notice and/or fails to complete the same within reasonable time, as determined by NIA, then NIA shall either,

a) by Contract or otherwise, remove and replace or correct such defective work and charge the cost thereof to Contractor or,

b) terminate Contractor's right to continue with the Works as provided in Article GC-21, NIA'S RIGHT TO TAKE OVER THE CONTRACT WORK.

Failure or neglect by NIA to reject such defective work shall not be construed to imply acceptance of the same and shall not relieve Contractor of his responsibility to perform the Works required by the Contract. NIA shall have the right to require Contractor to remove and replace or correct all defective Works at any time prior to the final acceptance of the Works by NIA or prior to expiration of any guarantee provided in this Contract.
